TERMS OF SERVICE

(Updated January 2026)

PLEASE READ BEFORE COMMISSIONING

This Terms of Service Agreement ("Agreement") is entered into by and between Dol’s Art (“Artist”) and the Client (“Commissioner”) for the commission of a service ("Work"). By commissioning the Artist, the Commissioner agrees to the following terms:Article 1 (General Terms)
1. Artist is not responsible if you, the Commissioner, fails to read the Terms of Service Agreement which the Artist has provided.
2. Violation of this Agreement, depending on severity, may result in Blacklisting from Artist’s services and potential legal repercussions. Relevant violating information (excluding confidential information) may be published as documented evidence.
Article 2 (Provision of Materials)
1. Commissioner provides a clear and complete Work requirements and expectations upfront, including but not limited to reference materials and/or assets before Work begins.
2. Commissioner authorizes the Artist rights to use the Commissioner’s own character design and reference material for the use of the Work.
3. Artist warrants that they will not copy, replicate or heavily reference unauthorized materials.
Article 3 (Content Creation Restrictions (Artist Do not do))
1. Artist restricts creation of content including but not limited to NSFW, furry, underaged characters, gore, copied styles, and offensive content.
2. Artist will strictly create Work without any involvement of Artificial Intelligence (“AI”) And warrants Work is 100% human made.
Article 4 (Work Process Timeline)
1. Artist will start working once they have received their payment either in half or Full payment.
2. Once the Artist has gotten to the Commissioner’s Work queue, Work completion will take anywhere from 1 week to 6 weeks depending on complexity and the Artist’s schedule.
3. Once the Artist has finished sketching, the Commissioner will receive the sketch to inspect on and either approve said sketch or revise on details which require revision. (see “Article 5 (Revisions)”) After sketch approval the Artist shall start line art and rendering.
4. When the Artist has completed Work, the Artist shall deliver the Work to the Commissioner’s provided email and on commissioning service platforms such as Vgen
5. If there are any delays and adjustments to Work schedule, the Artist will inform the Commissioner.
Article 5 (Revisions)
1. Revisions such as poses and details can only be made before the Commissioner approves the Artist’s sketch. If the Artist had started line art and rendering and the Commissioner request those details to be revised, it cannot be done as the Commissioner has "approved" said things earlier.
2. Revisions may affect Work delivery time.
3. Revisions after the rendering process can be made only about the rendering process.
4. Once the commissioner has fully inspected and approved the final Work, no revisions can be made further.
5. Revisions are for free when:
(1) Artist did not follow a clear instruction or have missed out on details Commissioner has provided.
(2) Small details revised
6. Revisions will cost additionally when:
(1) Big changes to the Work
(2) Commissioner want to add additional details which they have left out.
Article 6 (Communication)
1. Communication and discussion will occur throughout the project, including work in progress, idea generation and collaboration, situational updates, and more.
2. Communication channels may include Emails, Discord, X private messages, Instagram private messages and/or others.
3. Artist response time may vary, up to one week.
Article 7 (Payments and Fees)
1. Invoices, proposal or payment link will be sent to the Commissioner when Artist is ready to begin work. The commissioner must not send money before these requests for payment from the Artist.
2. Invoices must be paid within 96 hours, or the project may be cancelled or moved back in queue.
3. Prices are in USD, and paid via VGen, PayPal, or methods as provided by the Artist.
4. Prices may vary or change depending on complexity, requirements and/or additional requests.
5. Once Work has begun or payments have been made, the Commissioner acknowledges Work and deliverables are digital and there are no physically shipped goods to receive.
6. Commissioner warrants they will not issue chargebacks and the Refund policy mentioned below will be followed.
Article 8 (Cancellation and Refund policy)
1. If Work has not started and the Commissioner were to Cancel, a full refund of the amount which the Commissioner has paid will be provided.
2. If the Artist has finished sketching and the Commissioner were to Cancel, the Commissioner will receive only a 60% refund as a 40% labor fee for the sketch with additional labor fee if said sketch has been revised. Each revision will cost an additional 20% labor fee
3. If the Commissioner has approved said sketch, such refunds can no longer be made.
4. Commissioners have the right to receive a full refund if the delivery has been late by 31 days or longer and Work has not been delivered and there was no agreed upon amendment to the timeline.
Article 9 (Termination)
Any of these acts will result in the commissioned Work be paused and considered completed by both parties without refunds or further work from Artist.
1. If the Commissioner fails to respond to Artist’s questions, updates and/or sketch approval requests for a time period longer than 20 days.
2. If the Commissioner commits the acts of Harassment and/or Discrimination towards Artist.
3. If the Commissioner disclosed sensitive Confidential information to unauthorized parties, “doxxing” (see “Article 11 (Confidentiality)”).
Article 10 (Rights and Usage)
1. Usage Definitions
(1) “Personal usage” the utilization of Work solely for private, non-monetized and non-commercialized usages, such as for personal enjoyment.
(2) “Monetized content” commercial usage of Work which is monetized and/or used to promote Commissioner’s business, including but not limited to monetized contents (YouTube, Twitch, etc.), streaming assets, branding marks (profile pictures, banners, etc.)
(3) “Commercial merchandising” commercial usage of Work on merchandise products (sold prints, keychains, pillow covers, clothing design, etc.) by Commissioning Work to be used as Commercial merchandising, Monetized content usages is also included and not needed to be paid for separately.
2. Usage Terms
(1) Commissioner must provide clear and complete information about Work usage purposes to Artist upfront.
(2) Commercial usage rights are not included unless specified in the commission type or listing on the Artist’s websites (i.e. vtuber models, stream overlays, emotes, and so forth) or as agreed upon.
(3) Additional charges will be required for commercial usage if not included.
3. Artist Rights
(1) Artist reserves the right to cancel and refund the order at any time for any reason.
(2) Artist retains all copyrights over the commissioned Work. (Unless a Transfer of Ownership has been made)
(3) Artist reserves the right to publish the commissioned Work online, and in their portfolio unless it has been discussed and agreed not to.
4. Commissioner Rights
(1) Commissioner reserves the rights to request for updates from the Artist at any time.
(2) For Personal uses, Commissioner can NOT edit, modify, resell or redistribute the commissioned Work or claim it as Commissioner own.
(3) Commissioner may post the commissioned artwork as long as proper credit is given.
(4) Commissioner can NOT edit or remove Artist’s watermark and signature from the commissioned Work.
5. Usage of Work for artificial intelligence (“AI”) tools; platforms, programs or machine learning, NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited.
Article 11 (Confidentiality)
1. Artist and Commissioner acknowledges that information and materials that are provided to either party including but not limited to : personal information, technical information, business plans, payment information, any information marked as “Confidential”, or are incorporated into the deliverables, that are not public information shall be considered confidential information and shall not be disclosed or replicated to any other unauthorized parties without prior written permission from the owner of the confidential information (“Disclosing party”) to the Confidential information recipient (“Receiving party”)
2. Excluding Confidentiality, any of the following information is not considered Confidential information:
(1) Information which are public domain prior to disclosure.
(2) Information which enters public domain through no fault of the Receiving party.
(3) Information which the Receiving party already possessed prior to disclosure.
Article 12 (Terms of Service Consultation)
Any matters that have not been mentioned in this Agreement or any doubts in interpretation that may arise from this Agreement and its contents shall be consulted and discussed mutually between both parties in good faith for resolution.
